With e-discovery really starting to get traction in the courts, it is a matter of time before e-discovery problems reach your front door. While I appreciate that not my problem point of view, it seems to me that the ROI and increase in business efficiency and risk mitigation if executed properly is substantial.
Of course, the market is full of e-discovery experts and archiving tools and perhaps creating some serious credibility problems. Some things I found to better find solutions include:
- Does the vendor eat their own dog food?
- Do your vendors have reference customers?
- What is your legal teams knowledge?
- Do the consultants solving the problem have
expertise both legal and technology
backgrounds?
