If IT and legal were to work ahead of time to resolve the complex issue of policy and technology alignment, a company would realize substantial savings and lower the overall legal costs and risks. Why does this not happen? Well, it may be that there simply is a perception gap. Technologist see lawyers in a negative light of "divorce lawyers" rather than the "corporate protectors" and the lawyers see the technology people as "geeks" rather than a peer that has expert knowledge that others often find to be confusing. Any thoughts? Of course technology is part of the solution. The bigger picture requires companies to get behavior to change. For example, if a company were to randomly audit the e-mail accounts of say 24 employees for compliance with the policy of keep and archiving only e-mail that is pertinent to work, I am sure they would find over 50% of the employees fail. If the company were to then simply post a company wide e-mail announcing that 50%+ failed and that the failure was noted in these employees HR records, with potentially adverse impact at bonus time. I can that anecdotal evidence indicates that there is a decrease in garbage e-mail preservation by 20%+. Anyone else give this simple idea a try? Did you have the same results? I am always looking to learn from others and see how other companies are working with their employees to address the complex and rapidly evolving techno-legal issues. Regards, Daniel
